LEGAL NOTICE, PRIVACY POLICY and PERSONAL DATA COLLECTION AGREEMENT

We would like to inform you that Reg.UE 2016/679 (European Regulation about personal data protection) expect people and other subject protection and the respect of the personal data processing.
According to art. 13, therefore, we provide you the following information in your quality of Data Subject:

1. Data type and purpose of processing

Personal data that you provide and that can be processed are:
- Common data;
- Specific data – economic.

2. Purpose of the processing, mandatory and/or optional data, and consequences of a possible denial

Personal data that you provide can be processed for the following purposes:
- Fulfillment of account and fiscal obligation - Art.6 Comma 1 Let. b - (The provision of these data is mandatory and any refusal to provide such data can imply the total or partial failure of the contract and can compromise the continuity of the relationship);
- Fulfillment of contractual obligations towards the Data Subject by executing an act, plurality of deeds or a set of operations necessary for the accomplishment of those obligations - Art.6 Comma 1 Let. b - (The provision of these data is mandatory and any refusal to provide such data can imply the total or partial failure of the contract and can compromise the continuity of the relationship);
- Accomplishment of legal obligations, regulations or legislation of European Community - Art. 6 Comma 1 Let. c - (The provision of these data is mandatory and any refusal to provide such data can imply the total or partial failure of the contract and can compromise the continuity of the relationship);
- Dispatch promotional communications about products or services (The provision of data is optional and any refusal to provide such data has no consequence).

3. Methods of processing

In relation to the indicated purposes, your data are processed electronically and on paper. The processing operations are carried out in such a way that guarantees the logical and physical security and the confidentiality of your personal data. The Data Controller does not have an automated decision-making process and the data provided are not used to make profiling.

4. Legitimate interests pursued by the Data Controller or third parties

a) The Data Subject has given his permission to processing their personal data for one or more specific purposes;
b) the Data Subject has given his explicit authorization to process such personal data for one or more purposes, unless in cases where European Community or Member State law provides that the Data Subject cannot revoke the prohibition referred into paragraph 1;
c) the data processing is mandatory for the execution of a contract of which the Data Subject is a party or for the execution of pre-contractual acts put in place on their own request;
d) the data processing is mandatory to fulfill a legal obligation to which the data controller is subject.

5. Communication and data circulation framework

Your data may be transmitted to:
- all subjects to whom access is allowed by regulatory measures;
- to our collaborators and employees in the execution of their duties;
- to all those individuals and/or legal entities, public and/or private when the communication is mandatory or necessary to the performance of our business and in compliance with the purposes described above, and in particular: Business Agents, Distributors, Collaborators, Hardware and Software Providers, Banks, Insurance Companies, Freight Forwarders and Couriers, Administrative, Legal, Accounting and Tax Consultancy Studies, Web Agency.
Your data will be transferred to a recipient in a third country or to an international organization.

6. Mode and duration of personal data retention

The data are stored both on paper and in electronic archives for 10 years, in order to comply with legal obligations that could be fiscal or documentary storage.

7. Identification details of the Data Controller

The Data Controller is G.Comm S.r.l. info@gcomm-online.com. Considering that the type of data processing is not on a large scale, a Data Protection Officer has not been appointed. The updated list of data controller and data users is kept in the registered office of the Data Controller.

8. Rights of the Data Subject

You can, at any time, exercise the rights of:
a) access to your own personal data;
b) ask for the correction or deletion of personal data or ask for a the limitation of data processing;
c) object to the data processing;
d) data portability;
e) revoke the authorization, where expected: the revocation of the authorization does not prejudice the lawfulness of the data processing on a permission granted before the withdrawal;
f) make a claim to the supervisory authority (Privacy Guarantor).

What are cookies?

Cookies are small text files that are stored in the device used by the user (computer, tablet, smartphone …), when he visits a website, to improve the experience.

Typologies of cookies

Session Cookies

Session Cookies are essential to be able to distinguish individually connected users, and they are useful to avoid that a required feature can be provided to the wrong user, as well as for security purposes to prevent cyber attacks on the site. Session cookies do not contain personal data and last only for the current session, i.e. until the browser is closed. No consent is required for them.

Functionality Cookies (or Persistent Cookies)

These cookies remain stored in the user device until a certain termination date (expressed in minutes, days or years since the creation/update of the cookie). No consent is required for them.

Profiling Cookies
Targeting Cookies or Profiling Cookies are used to show contents that are more suitable for the user as regards his interests. They may be used to display targeted advertising, to post customized advertisements according to the user interests or to limit the number of times an advertisement is viewed by the user. Furthermore, they help measure the effectiveness of advertising campaigns on the site; the manager of the site may use such cookies to remember the sites visited by the users and to share this information with third parties, including agencies and advertisers that might use their cookies to collect information on the activities carried out by the users on the site.

Third-Party Cookies

This site also acts as an intermediary for Third-Party Cookies, used to provide additional services and functionalities to visitors and to improve the use of the site, such as keys for social networks (Facebook, Twitter, Linkedin …), or video (Youtube). This site has not any control over these cookies, entirely managed by third parties. As a result, the information on the use and the purposes of these, as well as on a possible disabling, is provided directly by third parties.

In particular, the site can make use of the following tools, which generate third-party cookies:

  1. Google Analytics

Google Analytics is an analysis tool provided by Google that collects anonymous browsing data (IP truncated to the last octet) through the use of cookies (performance cookies). These anonymous browsing data are aggregated in order to exclusively examine the use of the site by the users, fill out reports on activities on the site and providing other information, including the number of visitors and pages visited. Such cookies have been set by us anonymously, in order to reduce to a minimum the possibility of identifying the user by Google or other third parties.

Moreover, Google may transfer the information to third parties, should it be required by law or should the third parties process the information above on behalf of Google. Google shall not associate the IP address to any other data owned by Google. The data generated are processed and retained by Google as referred to in its own policy statement.
In accordance with a specific agreement with Google, Google is appointed Data Processor, and under this agreement it undertakes to process data in accordance with the Data Controller requests, that are made through the software settings.

  1. Youtube

Youtube is a platform owned by Google, for sharing videos, which uses cookies to collect user information and browsing devices. The data generated are processed and stored by Google as referred to in its own policy statement.

  1. Plugin Social Network

The site may incorporate plugins related to social networks, in order to allow easy sharing of content on them. When provided by the social network, these plugins set cookies, normally only if the user actually and voluntarily uses them. Please note that if the user navigates the site already logged into the social network, then it implies that the user has already consented to the use of cookies conveyed through the site at the time of registration to the social network.

The collection and use of information obtained through the plugins are governed by the respective privacy policies of the social networks.

Data transfers to non-EU countries

This site may share some of the data collected with services located outside the European Union area. Specifically with Google, Facebook, LinkedIn, through social plugins and the Google Analytics service. The transfer is authorized based on specific decisions of the European Union and the Italian personal data protection Authority; in particular the decision 1250/2016 (Privacy Shield) for which no further consent is required. The aforementioned companies guarantee their adherence to the Privacy Shield.

Should the user consider the processing as non-compliant, he shall report to the supervisory Authority, pursuant to article 77 of Regulations.
